Being arrested vs being charged with a crime?
Getting arrested means that you were taken into police custody. Once you are in the custody of the police, the prosecutor's office, will decide whether to charge you with a crime.
If youโre charged, youโll be given a charging document, (sometimes called complaint or information. This document will state exactly crimes(charges) youโre facing.
How do you know if youโve been convicted?
If you are never charged with a crime, you cannot be convicted. If you are charged with a crime, but the charges were dropped, you cannot be convicted unless new charges are filed later. If you are brought before a court and plead guilty or are found guilty, then you have been convicted.
How do I invoke the right to remain silent?
Suspects may invoke the right to remain silent by telling officers that they do not wish to answer any questions, or that they wish to say nothing until their attorney is present. If an officer continues to ask questions, the suspect's Fifth Amendment rights have been violated and any statements elicited from the suspect are inadmissible in court.
Is an officer required to give miranda rights?
Miranda warnings are required when a person is in police custody and when they are subject to police interrogation. If a suspect is not in police custody or voluntarily agrees to police questioning, no Miranda warning is required and any statement made by the suspect can be used against them as evidence in a trail.
